ACCIDENT REPORTING

The employer must inform the commission immediately of an accident that results in a fatality, injury to a worker that prevents him or her from working for 10 consecutive days, injuries to several workers that prevent them from working from one day, or damage in excess of $50,000. A written report must be submitted within 24 hours. The accident scene must be left undisturbed until investigated by an inspector.

 

The health and safety committee must also be informed and provided with a copy of the written report. (Occupational Health and Safety Act, 62)

 

FIRST AID

Signs

Signs must be posted indicating how to find the first-aid kits, and the work location and name of the first-aid responders. (First Aid Minimum Standards Regulation 1922-84, 13)

 

Facilities and supplies

There must be an adequate number of first aid kits in the workplace. The kits must be placed as near as possible to work areas, be easy to reach and available at all times. The minimum content of the first-aid kits is listed in the following table:

First aid responder

There must be at least one first-aid responder present at all times during working hours where there are 50 or less workers on a shift. There must be an additional first-aid responder for every additional 100 workers or fraction thereof. (First Aid Minimum Standards Regulation 1922-84, 13)

 

Records

The first-aid responder must fill out a report every time first-aid is administered. The report must be kept in a register reserved for that purpose. (First Aid Minimum Standards Regulation 1922-84, 15)

 

WORKERS COMPENSATION BOARD (WCB) CLAIMS

An injury that happens at work while the worker is working is assumed to be a workplace injury. An injury that results from gross and willful negligence of the worker is not considered a workplace injury unless it results in death or severe permanent physical or medical impairment. (Industrial Accidents and Occupational Diseases Act, 27 - 28)

 

Employer report

The employer must notify the Commission within 2 days of the worker returning to work if that is less than 14 days after incurring the injury, or within 2 days after the fourteen days following the accident, whichever comes sooner. (Industrial Accidents and Occupational Diseases Act, 269)

 

Worker notification

A worker must notify his or her employer of a workplace injury as soon as possible and before leaving the premises. (Industrial Accidents and Occupational Diseases Act, 265)

 

Worker benefits

The employer must pay compensation for lost wages at 90% of net salary for the first fourteen days after the injury occurred. (Industrial Accidents and Occupational Diseases Act, 60)
